Sales Rules
All sales are final. No purchase can be returned, refunded or exchanged. All property is sold "as is"  “where is” as exhibited.

Purchasers should be prepared to pay for their purchases via credit card, cash or personal check if attending the event. Faxed bidders not in attendance must pay via credit card.

The IRS states that an individual is entitled to a tax deduction only to the extent that his or her payment exceeds the fair market value of the item received. The Sam and Adele Golden Foundation for the Arts, Inc. is provided the fair market value of the artwork from the donor artist.

The Sam and Adele Golden Foundation for the Arts reserves the right to withdraw any work of art at any time before the actual sale.

The Sam and Adele Golden Foundation for the Arts makes no warranties or representation of any kind or nature with respect to any work of art including, but not limited to, any representations or warranty of description, genuineness, attribution, provenance, or physical condition, nor as to the right of reproduction, if any.

Purchasers may not rely upon any statement, oral or otherwise, other than as set forth in these conditions of sale.

Conditions of Sale
The Sam and Adele Golden Foundation for the Arts advises buyers to read the Conditions of Sale.
All net proceeds from the sale of art will go to support the endowment of The Sam and Adele Golden Foundation for the Arts, Inc.

Each work carries estimated market values obtained from sources the artist believes to be reliable, but no representation of warranty as to the actual resale value of any work being sold is made or implied.

Please see the “Bid Fax Form” for specific details for the October 6, 2007 Benefit Silent Auction.

Condition of Lots
Each work is sold "as is" per our Conditions of Sale.

Payment
Payment via credit card is required for faxed bids.

Pick-Up and Delivery
Transfer of the work will not occur until payment has been received in full.
The buyer is responsible for shipping or picking up the work from The Sam and Adele Golden Foundation for the Arts, Inc.’s offices located at 188 Bell Road, New Berlin, NY 13411, no later than Friday, October 12, 2007, 5 PM.

The Golden Foundation may, in its discretion and at a purchaser's request, package and ship items as directed by the purchaser. In such event, purchaser agrees to the following conditions:

All such packaging, handling, shipping and insurance is at the sole risk of the purchaser and the Golden Foundation shall have no liability for any loss or damage to such items; and

Purchaser shall pay all related expenses in advance. Allow 4-6 weeks for shipping.
